By accessing and using the Tekvwa Analysis Platform ("the Platform", "the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.
2. Service Availability
Tekvwa Analysis is a globally available service with no geographic restrictions. Users from any country may access and use the Platform, subject to these Terms. While the Platform is operated from and registered in Canada, it serves users worldwide.
By using the Platform, users in all jurisdictions agree to be governed by these Terms, which are based on Canadian law. Users are responsible for ensuring their use complies with their local laws and regulations.
3. Description of Service
Tekvwa Analysis is a web-based statistical analysis platform that provides:
- Statistical analysis tools (regression, correlation, time series, etc.)
- Data visualization capabilities
- AI-powered report generation using OpenAI GPT-4
- Data import and export functionality
- Session-based data management
4. User Responsibilities
4.1 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms and applicable Canadian laws. You agree NOT to:
- Upload malicious files or code
- Attempt to gain unauthorized access to the system
- Use the Platform to process illegal or harmful content
- Reverse engineer or attempt to extract source code
- Overload the system with excessive requests
- Share access credentials with unauthorized parties
4.2 Data Responsibility
You are solely responsible for:
- The accuracy and legality of data you upload
- Ensuring you have rights to use and process the data
- Compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA)
- Maintaining backups of your original data
- Protecting sensitive or personal information in your datasets
5. Intellectual Property
5.1 Platform Ownership
The Tekvwa Analysis Platform, including its source code, design, documentation, and functionality, is the confidential and proprietary intellectual property of Tekvwa IT Solutions LTD, protected by applicable copyright, trademark, and trade-secret laws.
5.2 Proprietary Licence — No Rights Granted
The Platform is proprietary software and is not open source. No licence to use, copy, modify, distribute, sublicense, sell, host, or reverse engineer the Platform or its source code is granted except under a separate signed written agreement with Tekvwa IT Solutions LTD.
5.3 Your Data
You retain all rights to the data you upload and the analysis results generated. The Platform does not claim ownership of your data or outputs.
6. AI-Powered Features
6.1 OpenAI Integration
The Platform uses OpenAI's GPT-4 API for report generation. By using this feature:
- Your analysis results may be sent to OpenAI for processing
- You agree to OpenAI's usage policies
- AI-generated content should be reviewed for accuracy
- You are responsible for the final use of AI-generated reports
6.2 Accuracy Disclaimer
AI-generated insights and recommendations are provided for informational purposes only. You should:
- Verify statistical interpretations independently
- Consult qualified professionals for critical decisions
- Not rely solely on AI-generated content for medical, legal, or financial decisions
7. Privacy and Data Protection
7.1 Privacy Law Compliance
We are committed to protecting your privacy in accordance with Canadian privacy legislation, including:
- Personal Information Protection and Electronic Documents Act (PIPEDA)
- Applicable provincial privacy legislation
- Canada's Anti-Spam Legislation (CASL) where applicable

Your data is processed locally on the server during analysis. We do not:
- Store your raw data permanently (unless saved to database)
- Share your data with third parties (except OpenAI for report generation)
- Use your data for purposes other than providing the Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY CANADIAN LAW, INCLUDING BUT NOT LIMITED TO:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy of results
- Uninterrupted service
8.2 Statistical Results
While we strive for accuracy, statistical results should be:
- Verified by qualified statisticians for critical applications
- Cross-checked with other statistical software when necessary
- Interpreted in the context of your specific data and research questions
8.3 No Professional Advice
The Platform does not provide professional statistical, medical, legal, or financial advice. Results are for informational and educational purposes only.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW:
- The developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Total liability shall not exceed the amount paid for the Service (if applicable)
- We are not liable for data loss, business interruption, or decisions made based on Platform outputs
10. Indemnification
You agree to indemnify and hold harmless the developers from any claims, damages, losses, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Data you upload or process through the Platform
11. Modifications to Service
We reserve the right to:
- Modify or discontinue the Service at any time
- Update these Terms and Conditions
- Change features or functionality
- Implement usage limits or restrictions
Continued use after changes constitutes acceptance of modified terms.
12. Termination

13. Governing Law and Jurisdiction

The Platform is registered and operated from Canada, which serves as the legal base for all operations worldwide.
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. By using the Platform from any location worldwide, you consent to this jurisdiction.
14. Dispute Resolution
Before initiating any legal proceedings, you agree to attempt to resolve any dispute through:

- Good faith negotiation for a period of at least 30 days
15. Severability
If any provision of these Terms is found to be unenforceable under Canadian law, the remaining provisions shall continue in full force and effect.
16. Language
